ProbationCall is NOT a substitute for personally calling your probation reporting hotline. This service is provided as a convenience tool only. Technical failures, network issues, speech recognition errors, and other problems may occur that could result in incorrect or missed notifications.
YOU ARE SOLELY RESPONSIBLE for ensuring compliance with your probation requirements. Always verify your testing status through official channels. Failure to report for required testing may result in serious legal consequences including arrest, incarceration, probation revocation, or other penalties.
By using this service, you acknowledge and accept ALL risks associated with relying on an automated system for probation-related matters.
1. Acceptance of Terms
By accessing or using ProbationCall ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.
2. Service Description
ProbationCall is an automated phone call service that attempts to:
- Place automated calls to probation reporting hotlines on your behalf
- Use speech recognition technology to interpret the recorded message
- Send notifications about the interpreted results via email, SMS, or WhatsApp
The Service is a convenience tool only and is not affiliated with, endorsed by, or connected to any government agency, court system, probation department, or law enforcement entity.
3. No Guarantee of Accuracy or Reliability
⚠️ Important Limitations
You expressly acknowledge and agree that:
- The Service may fail to place calls due to technical issues, network problems, or service outages
- Speech recognition technology is not 100% accurate and may misinterpret messages
- The Service may report incorrect results (e.g., indicating "no test required" when testing IS required)
- Notifications may be delayed or not delivered due to email, SMS, or network issues
- The hotline message format may change without notice, causing the Service to fail
- Scheduled calls may not execute due to server issues, maintenance, or other technical problems
- The Service may experience downtime without prior notice
4. User Responsibilities
You are solely responsible for:
- Complying with all terms and conditions of your probation or supervision
- Verifying your testing status through official channels (calling the hotline yourself)
- Reporting for any required drug/alcohol testing on time
- Not relying exclusively on this Service for probation compliance
- Maintaining accurate contact information for notifications
- Ensuring you have sufficient credits for scheduled calls
- Understanding that this Service is a backup/convenience tool, NOT a primary compliance method
5. Assumption of Risk
By using this Service, you expressly assume all risks associated with:
- Relying on automated technology for probation-related matters
- Potential inaccuracies in speech recognition
- Possible service failures, outages, or delays
- Any consequences resulting from missed or incorrect notifications
- Any legal consequences arising from failure to comply with probation requirements
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We expressly disclaim all warranties, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties of accuracy, reliability, or completeness
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties that results will be accurate or that defects will be corrected
7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBATIONCALL, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Arrest, incarceration, probation revocation, or any legal consequences
- Fines, penalties, or additional probation requirements
- Emotional distress, anxiety, or other personal harm
- Any other damages arising from your use of or inability to use the Service
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Indemnification
You agree to indemnify, defend, and hold harmless ProbationCall, its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any probation terms or legal requirements
- Any claim that your use of the Service caused harm to you or any third party
- Any legal proceedings related to your probation status
9. Not Legal Advice
Nothing in this Service or these Terms constitutes legal advice. We are not attorneys and do not provide legal services. If you have questions about your probation requirements, consult with your probation officer or a qualified attorney.
10. User Accounts
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account
- You must be at least 18 years old to use this Service
- We reserve the right to terminate accounts at our sole discretion
11. Payment and Refunds
- Credits are purchased in advance and are non-refundable
- One credit equals one automated call attempt
- Credits do not expire but may be forfeited if your account is terminated for Terms violations
- We reserve the right to change pricing at any time
12. SMS/Text Message Terms
If you opt in to receive SMS notifications:
- Message frequency: Up to 1 message per scheduled call (typically 1 per day)
- Message and data rates may apply
- Reply STOP to unsubscribe at any time
- Reply HELP for assistance
- We do not share your phone number with third parties for marketing purposes
13. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Use the Service to harass or harm others
- Reverse engineer or attempt to extract source code
- Resell or redistribute the Service without authorization
14. Service Modifications and Termination
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time without notice
- Change features, functionality, or pricing
- Terminate your account for any reason
- Remove or modify any content or data
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ProbationCall regarding your use of the Service.
